  • Sustainably good Corporate Governance

    Again and again, it can be seen that recurrent non-compliance with corporate governance principles without comprehensible reasons does not lead to public sanctions by the peers in this country, at least not as long as the public prosecutor's office does not investigate. In cases such as Wirecard or Volkswagen, the lack of a voice of the members of the Management Board and Supervisory Board can be misinterpreted as a misunderstood esprit de corps. Corporate leaders still find it difficult to talk publicly about issues that do not directly affect their own business. The danger is seen as too great that one's own opinion could cause a problem with any stakeholder and that one could become the subject of a public debate.

    It is attitude and leadership that the man or woman in the street expect from the management. Surveys show this impressively. Attitude generates trust, which remains at a low level in respect to the economy. Therefore, management should also show an attitude when it comes to the topic of corporate governance. As an active part of the business system, which thrives on the trust of the public, it is important not only to observe, but also to engage publicly in debates - in the sense of good corporate governance that is vital, lived, modern and sustainable.

  • Cum-Ex litigation mandate - On March 18th, 2020 a long and intense proceedings on the Cum-Ex complex at the Regional Court in Bonn has come to an end. It was the first trial in which it became clear that it was ultimately a cum-ex industry with a variety of players.
